Terminated IVA and Land Registry charge
Options
hi thanks for reading. My IVA failed and was terminated last May 2019. It was originally with ClearDebt, who then were bought by Apeture and now I believe are being run by Jarvis.
My question is, there is still a registered charge on my property in the name of Clear Debt's insolvency practitioner. As the IVA is terminated does this mean this charge will remain and I will be unable to sell my property?
I have not had any contact with any of the creditors since the agreement failed.
Thanks

Should have said. Can I apply to remove the restriction? Or does it remain there in perpetuity? Nothing in any of the documents i have says anything about this.0

Sorry not much help but if mortgage is in joint names then the charge be null and void as it would just be a restriction0

Tootles did you ever get help with this as I’m in the same situation, ours ended/failed many years ago and it’s on our house deeds, but the companies I owed haven’t made any contact with me and I’m leaving my house to my sons so wondering what needs to be done to have it removed.0

OP was last active in January 2023, I doubt they are coming back to update us.
@dobby33 there is a charging order thread in the sticky posts on the Debt Free Wannabe board, the Land Registry Rep is quite active on that thread, you can ask on there.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
