Consumer rights act? Time being of the essence was implied from paying for expedited delivery. Therefore failure to deliver means you can cancel for refund.
Technically you could have rejected the full order if you wanted to.

Made my first order from Approved food last week when i seen offer on MSE order was only £22 it arrived about 5 days later that was ok sell by date 6 months out, i did expect it to be out but not that long it was still in best before date they said
1. coffee very bitter taste 2. curry jars seals had been broken 3. tapas wouldn't give them to pigs 4. crisps damp 4. chocolate made my son sick. all order returned
customer service rubbish they offered me £8 voucher which i refused then they said order as been received and told me nothing was wrong with order and it cost £8.50 to return so no refund
papal claim opened also reported environmental heath officer food safety ( his worlds not these again )
MSE need to be vigilant
this is example of their reply as previously advised best before date refer to quality not to the safety of the product
how do you know they are unfit goods are unopened by saying this they are hoping to get away with this rubbish
