Attachment of Earnings on Furloughed Pay and being made Redundant

I have been on the furlough scheme since March and and have recently discovered that from Nov 5th I will be made redundant.

My employer has just emailed me to notify me of an Attachment of Earnings order that has been sent into them. Will that still be able to attach to either my final furloughed monthly wage or my statutory redundancy payment of 3 weeks wages?

Thank you in advance for your help.

Chris

Yes? That's how these orders work

Not sure how else to put it really. It's an attachment to earnings order - if you don't want one, ensure you defend any court claims / pay your debts

AFAIR They don't deduct anything from redundancy pay. They deduct multiple weeks/months from notice periods including gardening leave, depending on their length. PILON is in theory one large payment so they should deduct from that in line with the AoE order, which could be nothing. Do you have a copy of the AoE order?

  • If it helps, when I got AOE in late Aug it didn't start until a whole month later. I work for a small business who have overlooked taking any money out of my wage this month though when we are only on the 2nd instalment. (I was recently considered for dismissal)
