Landlords False Claims

Hi, we are moving out of our property in a couple of weeks.
The landlord came to do an inspection and is making claims which are completely untrue.
For example, he claims the house will need to be professionally cleaned as it smells heavily of smoke - we aren't smokers!
How do I prove the house doesn't smell when I try to get my deposit back through the scheme?

    You dont. The landlord needs to prove it does. The onus is on the landlord as he is claiming against you

    Just claim your deposit back and let the LL dispute it. He will need evidence, which he doesn't have.
    No free lunch, and no free laptop ;)
  • Deposit is your money, not landlord's.  Start dispute process with protection scheme is not resolved soon.

    As a back-up, have an independant witness (ie friend not relative) visit and write a statement stating there is no smell of tobaco.
    You can submit this to the dispute arbitrators as evidence to counter whatever claim the LL makes.
    The issue you might face is if the LL uses a professional (The AIIC ) inventory clerk to do the check-out inspection, and their report mentions the smell.

    Yellow walls etc. go along with heavy smoking, photos of the tops of clean walls may help.
