SOA for Trust Deed

Hi,
I am going down the road of a trust deed - still to be confirmed, may be bankrupsy. The debt is pretty much all HMRC.
I live with my wife. She is nothing to do with the process and will not be involved. She owns the house solely.
I am self employed, sole trader, so i have a van on HP. The payments for that are run through the books so therefor i have not included them in the SOA, nor anything else that is payed for via my business account as these are all taken into account for my income calculation. Also, my income varies so have tried to use what is a typical monthly income averaged over last three months, but there is a bit of fluctuation, such as Jan/Feb are quiet months so may be a bit of a dip in income, maybe 20%. Conversely there may be a couple of months where we do better so it should work itself out.
The household expenses are all my half of the bills.
Any help would be appreciated before i go to my insolvency practitioner. Thanks in advnce.

Afternoon - you pay £800 rent to your wife who owns the property, is that correct? Not sure about Scotland, but in England that would likely mean you had a beneficial interest in the house, as you are paying towards it.
Have you taken advice from a free debt charity who understands Sottish law?

Echoing the point above, from your other post I see you have been living in wife/partners house for 10 years paying "rent" ie effectively contributing towards the mortgage. So if this were in England the OR would definitely consider that he has a potential interest in the house.0

I am advised the criteria is if it would be claimed in the event of a divorce the Accountant in Bankrupsy would be interested. I am advised I have no claim on the property in the event of a divorce.0
