Inheritance / Deed Poll

Hi,
If an uncle in the USA decides to leave his estate to someone in the UK who has recently changed their last name (without the uncle knowing), will their estate still go to that person? In other words, uncle in USA makes will to leave their estate to person in the UK (but that person in the UK changed their last name) but uncle did not update their will because they did not know this.  HOWEVER, that person has a deed poll that proves change of last name.

So will that person still inherit the estate when uncle dies and a solicitor gets involved?  I assume the solicitor will want a deed poll - is that all? How does it work?  Thank you.

Of course they will still inherit.  Females have been changing their names for hundreds of years and it's made no difference.

That makes sense when you put it like that.  But what confuses me is how will the solicitor in the USA contact the person who is due to inherit (won't it make it really hard for the solicitor to trace them especially since they changed their last name)?

Well, you could make it really easy for the solicitor in the USA by supplying the up-to-date name and address....otherwise, I guess, the estate will spend money tracing the beneficiary, their marriage, their present name, their present address etc etc... possibly reducing the amount the beneficiary receives...

Is there any reason not to tell Uncle about the change of name?

Use a UK based agent to trace and verify the individual.

Would you be in your uncles' address book? Your address might even be in the will.  Do you have any other relatives in touch with you both?
