Standard Council PCN - Quick Question & Help

Hi all, I have read many posts and all the generic templates but they seem a bit too much and long for my case. Awesome forum btw!!! I will try to keep it short, since is not a huge sum, however I would like to know if is the case to appeal and I have the basis to do so. I got the PCN when I left the car in front of where I live (can this be a detail to appeal?). Never saw tickets to other cars parked there (and they are a lot - everyday) so I assumed it was fine (I see cars parked there day and night but in my case it was parked only a couple of hours). Also the only close sing is stating "30 min, and no return within 1 hour"... Is 30 or 60 min then? In the PCN the 'observed from' is pretty tight, there is no grace period of extra 30 min or so? TY in advance for who will read and add a quick comment to help! Have a great day!  :)

    As it's council , try pepipoo fightback forums using a non Hotmail email address and post in the council section there after reading the posting requirements on there

    Probably because they are irrelevant with council penalty charges.  

    As we major on private parking tickets here, PePiPoo will be your best bet for council tickets. Register there but please note that a hotmail address won't work - try using a throwaway gmail account instead if you do have trouble registering and post a new thread; here's your link:


    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate) as they need to see all the small print.

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Any get-out you have will be on a technicality ... the sing (sign) is clear - you can park there for a maximum of 30 minutes at a time, and once you've parked there then you cannot park there again for at least another hour. (e.g. if you parked there between 1pm and 1.30pm then you can't start parking there again until 2.30pm). The restrictions are in force Monday to Saturday between 8am and 6pm.

    You received the PCN because you parked there for 55 minutes ... 25 minutes over the allowed period.

    Reading the above , it seems correct to me after reading post one again

    No authority to leave a vehicle there for a couple of hours between those times Monday to Saturday , but can do overnight and on Sundays

    Definitely not at 1607 unless it was a Sunday which it wasn't as it was a Thursday

    In this case I believe the OP (thread starter) would be best cutting their losses and paying the reduced PCN value. Yes they might ultimately win at the 2nd level appeal (if the folks at Pepipoo find anything awry with respect to the paperwork), but the time and effort spent on this for no guarantee of success doesn't really make sense.

    You know ... if the private sc@mmers weren't so greedy with their PCNs then this whole problem that has led to a new CoP etc. probably wouldn't have arisen - people would have probably simply paid the 14 day bribe if it was £20 to £25, and the deluge of court claims wouldn't have happened.
  • The only way to prove conclusively that the vehicle was parked for longer than permitted (Code 30) is for the Civil Enforcement Officer (CEO) to make two observations at least 40 minutes apart. On each occasion the officer must record the wheel valve positions. If the valve positions are the same on both observations, it proves the vehicle has not been moved in between the two observations. The CEO must also allow 10 minutes grace after the 30 minutes expires from their first observation. Hence you can park for 40 minutes.  I notice the PCN states the observation was from 15:12 to 16:07 (55 minutes). The only thing to check is whether the CEO recorded the valve positions. CEOs sometimes get this wrong. Other than that, unless the traffic regulation order is incorrect, it is unlikely that an independent adjudicator would allow an appeal. If this is for an authority outside London you can search and view the Traffic Order on the Traffic Penalty Tribunal website.
