Don’t want to be screwed over help

Options
Hi
i was made redundant last week and I want to know to the penny what I’m owed.  They will try and screw me over.
ive spoken with Acas on phone and can’t get through to citizens advice but Acas wasn’t very helpful.
is there anyway I can email Acas or citizens advice sending my wage slips etc so they can make sure what I’ve been told etc is correct.
I’ve worked for said company 28 years. Part time.
Oh and it’s my family business.
I think they think I won’t check up on them.
Things will get better day by day.

12 weeks notice(or contractual if longer.
    Accrued unused holiday
20 years service for redundancy at between 0.5-1.5 weeks pay(capped at £538)  per year depending on age at relevant date for redundancy.
(assumes no break during the last 20 years)

if regular part time hours it will be based on that if not regular that can be different.

Dude, you keep saying capped at £538 - it's not capped. That is for the insolvency service scheme. I've said this before.

So what is it called then if not capped as that is statutory maximum payment as per government regulations regarding redundancy.

There is no cap for redundancy. There's a limit where the employer isn't obliged to go over; but that's not a cap. The employer is free to pay more if they choose

OP, It depends if you have a contract specifying redundancy terns or not,
If not there are specified minimums you can look up.
Can you let us know whether your part time hours were regular or variable, and is it correct that the company will continue trading?

  • I’m 46 years old.
Worked for them for 28 years.
Hours are 23rs per week Monday to Friday.
i used to cover other people’s holiday or sickness.
Not sure how to calculate weekly pay.
do I timed my monthly pay by12 the divide it by 52 to get weekly pay?
Then weekly divide by my hours to calculate my hourly rate?
Things will get better day by day.

And you were wrong then and you are now because you don't understand the difference between a statutory payout and a contractual/enhanced payout.

Statutory redundancy payout  is capped at £538pw.

contractual or enhanced can be anything a company likes but that is not a statutory redundancy payout.

    Lets agree to disagree.

As far as i'm aware a true 'cap' only applies to the insolvency service, the rest is in effect an optional maximum an employer is obliged to pay.

If I get paid £1000 a week the employer can pay me statutory and cap it at 538pw OR they can enhance that to my full pay of £1000 or even change it to any thing they want as long as it works out more than the statutory calculation.

There is a distinction between a statutory payout and an enhanced payout.
