Statutory Lease extension - Section 42 notice served and freeholder is not replying

Hi,
I've had my flat for 2.5 years now and I had a surveyor value the flat and had my solicitor serve a section 42 notice to the freeholder two months ago. The deadline for the freeholder to reply was last week so I've contacted my solicitor this week on what the next steps were.
My solicitor suggested that I give them another two weeks notice - but I thought that I would now have the upper hand as they missed the deadline so I would now just need to apply to the court for a vesting order. Is there a benefit/disadvantage for me not giving the freeholder the two weeks notice? or is it a long and possibly more expensive process getting the vesting order from the court?
Thank you,
Jessica

There isn't really an 'upper hand' - you are going to get your lease extended one way or another, it's just a question of process. If they don't reply, then you will need to vesting order. It's a bit longer and more expensive, but fairly procedural so it's not that bad.
Your solicitor should guide you on all this.
