Irresponsible Lending Query

Never seen any CC ask for a "affordability form"
Affordability is more around payday loans than Credit Cards.

Twinkiehq said:I was in an abusive relationship. My ex husband used to beat me. One day I decided I had the strength to leave. I took my two children and found a house to rent. I had no money. I took out a credit card to pay for the deposit and first months rent. I was working full time but on a single parents wage, the cost of breakfast clubs and after school clubs as well as monthly bills was more than I was earning. I applied for universal credit and as soon as that was sorted I chopped up my card and started paying small amounts back each month.
Does that help you further?I am looking for help and advice on how to handle this, not a lecture or bullying! If you don’t have anything helpful to say, I would much prefer you stopped commenting.
Did you update MBNA when you started to realise that you were getting into financial trouble?
Or did MBNA only receive that information after you had been to Step Change and they had passed it on to them? And as such in serious financial trouble.
Is MBNA the only CC that you owe money too? Or are there other debts as well?Life in the slow lane0 -

Even if they could find this form the damage would already have been done.
Now if you applied for more credit when under Stepchange - who has broken the rules now or does that not count?0 -

They lent you the money to escape an abusive relationship with your two children and instead of being grateful and paying them back you have decided to look for every loophole to avoid paying them back!!. Pretty immoral behavior if you ask me!4 -
I agree. It is really a bad attitude to have. Without their help you'd be either stuck with your violent ex or had to go into some crummy Council shelter.1

If you want to make an affordability complaint, send your complaint to MBNA, not PRA who are not responsible for MBNA's decisions to lend.
The FCA says all lenders should check on affordability before giving someone credit. But I think MBNA may have done this, the fact they wouldn't send the details to PRA doesn't mean they didn''t.
But Penguin_ mentioned the CCA agreement. This could be a simpler route for you to follow now. If PRA can't produce the CCA agreement for the debt, then it is unenforceable in court and you can stop paying it. This https://www.nationaldebtline.org/EW/factsheets/Pages/getting-information/credit-agreement-advice.aspx has details about asking for your CCA agreement.0
