No right turn help PCN



advice needed as follows. I have received a PCN £65 if paid within the next 14 days for a “no right turn” I did onto a road a week ago. Firstly I would like to state that there was no signs approaching the road at all, the sign was Infact placed straight ahead on the road I was turning into. I know this is confusing so I have posted a photo. The red dot represents where the sign was posted. I need clear advice on where a sign is supposed to be posted. As where it was situated is right next to a bus stop and where traffic, buses , large vans, lorry’s etc could easily block this view. I do not get tickets often and this is Infact my first in three years. I feel the sign isn’t in the correct place and is easily obstructed by taller vehicles. Can I appeal?

You are correct. Regulatory signage must be as per the Traffic Signs Manual Chapter 3

All traffic signs placed on a highway or on a road to which the public has access (right of passage in Scotland), as defined in section 142 of the Road Traffic Regulation Act 1984 and amended by the New Roads and Street Works Act 1991, must be either prescribed by Regulations or authorised by the Secretary of State for Transport (for installations in England), the Department for Infrastructure (Northern Ireland), the Scottish Government or the Welsh Government as appropriate. 1.2.2. Care should be taken to ensure that traffic signs are used only as prescribed in the Regulations, and in accordance with any relevant directions, and that no non‑prescribed sign is used unless it has been formally authorised in writing. Failure to do so may leave an authority open to litigation, or make a traffic regulation order (TRO) unenforceable.
