I am taking legal action against the owner of a property I got a copy of the title deeds. I am trying to determine if the property still has a mortgage on or has been paid off as it may have an impact on my case and I do not want to go into details its too long winded:
Standard Security by said (property owner name) to BANK OF SCOTLAND PLC incorporated under the Companies Acts (Company Number SC327000), Halifax Division, 1 Lovell Park Road, Leeds, West Yorkshire LS1 1NS.
Can anyone help this is the only bit I see in reference to a bank.
Thanks

Yes, that's a normal mortgage deed. Bear in mind it doesn't prove anything about how much (if anything) is actually owed to the bank.

Bear in mind it doesn't prove anything about how much (if anything) is actually owed to the bank.It means that the bank registered a security over the property, which is what normally happens at the start of a mortgage. It's quite common for it to continue to sit there after the mortgage is paid off, and only removed when it has to be i.e. when the property is next sold or refinanced.I mean, it's more likely than not that there is something owed, particularly if it was registered quite recently, but if what you're trying to figure out is whether the owner has a lot of equity in the property, it doesn't really prove much.0
