If you are already divorced was the house not mentioned as a joint asset at the time?0

You say you have a letter saying your dad loaned you, is it just you he loaned this too?emmajones1979 said:My ex and I got together in 2002, moved in together in 2004 and married in 2006. We bought our house in 2017 (my dad loaned me £26000 for a deposit) and both paid into a joint account to cover bills and mortgage. I paid £1000 more than him as I earned more. He moved out 12 months later. He hasn’t contributed to the bills or mortgage since. I now want to sell but he is demanding half the profits. Where do I stand legally? I’m getting so much differing advice. Has anyone been through this before? We have 2 children and he owes me £9500 in unpaid Maintainance.
I'm guessing this was registered with the bank when you took out the mortgage showing where your deposit came from. You would be better off getting a copy from the bank (or it could look like you have just had it drawn up if you know what I mean) rather than using your original, however if it is just saying he loaned it to YOU then your ex isn't liable.
What repayment terms are on this, is it on sale of property or monthly?
Does it say loan and not gift?
When you divorced what was finalised financially and is there a reason the house was not included in the financial settlement or why you both didn't have a clean break order, or is everything financial still to be settled?Forty and fabulous, well that's what my cards say....0 -
The interest is specified at the date of the loan, there is no requirement that the interest rate is "reasonable".ElephantBoy57 said:emmajones1979 said:The divorce came through earlier this year.
