    The way I read Coupon-mad's advice was that you provide an English address, a contact address.  Whereas here you have pretty much described yourself as resident in Scotland.

    Assuming this can go ahead on that basis, the PoFA failings need to be your first i.e. main section.  But in your draft they are split into two sections separated by the Signage and No Landowner Authority sections.  

    Main thing to sort out is how best to tell POPLA that the address at which you can be contacted is in England.  I also think you could do with clear headings for all 3 sections.

    The clearer absolutely everything is, the better.  POPLA assessors can need a fair bit of assistance.
  • @MistyZ That is the sticky point. I have to register the POPLA appeal under an English address but say the PCN was sent to my address in Scotland. I was thinking to add a NOTE after my signature at the end, saying something along the lines of:

    The original PCN was sent to my address in Scotland but because POFA rules don't apply there, I have chosen to submit my appeal under my business address at xyz (by the way, this is true, I do have a limited company registered in England).  ;)

    You also have the wrong POFA deadlines - 14 days does not apply to a hirer.  The failure is all about the missing documents.

  • Thank you @Coupon-mad. I've deleted the part about the 14 days (see my final draft on page 4 of this thread). So I mentioned POFA Paragraph 3 for signage, POFA Paragraph 5 for driver not identified and POFA 4 for the missing documents. Then at the end also put BPA Paragraph 7 for no Landower authority.

  • @Coupon-mad Yes, I undertand that POFA 13 and 14 relate to hired cars (I read the damn document until my eyes bled). I was just following the Newbies thread and KeithP's advice to mention signage and landowner authority. I guess it won't hurt to mention those as well.

    What didn't you like about Tank40's PoPLA appeal?
    I gave you a link to it. Perhaps you missed it. Here it is again:

    Note that the first point of his appeal was about the failure of the parking company to supply the necessary docs stated in POFA 4 paras 13 & 14.
    Also note that that was exactly the point that won him the appeal - the assessor not bothering to look at other arguments.

    Yes, use all the arguments you can, but put your strongest argument first.

    Why did you not consider using the actual text that got Tank40 a win?
    For most of your PoPLA, all you have to do is lift the text straight from Tank40's appeal.
    Instead, you have once again ended up with a confusing mish-mash of ideas all jumbled together.


    Anyway, that's just my opinion. Do what you think best.

    The structure of your appeal draft was based on different parts of the PoFA.  Headings relating to the different types of failings do make things clearer and that's what Tank40 has done.  

    I've won a hire car POPLA appeal structured in the same way as that appeal but I think his is better than mine was and it's there for the borrowing!  (As long as it's suitably customised).
