The bill introducing keeper liabiltiy in scotland isnt in force and cannot be retroactive
A friend of mine tells me the Transport (Scotland) Act 2019 changed the law in Scotland as of November 2019 and the creditor now has the right to recover any unpaid parking charges from the keeper of the vehicle.The provisions of that act for parking are not in force yet - and we don’t even have the details on how it will work or a date for when it might happen.

I sincerely hope Scotland decide not to enact that section. Much depends on how robust the MHCLG framework is and the parking charge levels, etc.
If the MHCLG fall short then Scotland could very easily (I hope) decide to distance themselves from more anti-consumer disaster and NEVER invoke keeper liability because they don't want the few hundred parking claims they see now to explode into the tsunami of over 100,000 parking claims they we now get in E &W per annum (most inflated with false add-ons, and most PAID by victims).
The Dept for Transport in 2012 and the Supreme Court have a lot to answer for - they caused all this.

But never give up, there is still scope to make certain things known to Ministers in Scotland, if the MHCLG framework and PAS232 is not robust enough. Much depends on what protections are offered and the level of parking charge - but most of all, removing the abusive added costs that cause the parasite firms to drive the PPCs to court. Reduce the money sloshing around and you take the rug out from those who steer the race to court.
I can't see Scottiish Government wanting their few dozen (few hundred?) parking claims each year exploding into the 110.000 per annum, roboclaim legal firm led bullying litigation that the people of E&W have suffered in the years since the broken and anti-consumer Schedule 4 was enacted.
If only someone would tell them.
