SMART & DRP Scotland

Hi folks.. Have read the stickys etc but after a bit reassurance or direction.. 

 Nearly 2 years ago.(20/11/2018). My 17yr old daughter received a ticket within her college car park for parking outwith the lines!! I'm sure it was Smart Parking possibly Euro however letter says UK Parking Control Ltd
 (a week before this one she got one for not displaying her permit < that was clearly displayed on the windscreen> haven't received a follow up for that one yet)

So we completely ignored everything.. Didn't contact them, didn't appeal.. She did converse with college pupil support who said "it's nothing to do with us"
So we got the usual 5 or 6 letters for each one then we've heard nothing in all this time.. 
And a letter from Debt Recovery Plus drops through the door demanding £145 today..I'm not worried and don't intend to contact them but 
I' m vaguely aware of something possibly changing legality wise in Scotland but can't find anything online regarding this.. 

Can anyone direct me to this?

    The bill introducing keeper liabiltiy in scotland isnt in force and cannot be retroactive

    Haha!  Anyway DRP letters are shown in pretty pics in post #4 of the NEWBIES thread.  No threads needed about them but come back if UKPC try a small claim later - they are fun to defend and 99% won here.

    Sorry Nosferatu, but are you 100% sure this comment is correct?
    A friend of mine tells me the Transport (Scotland) Act 2019 changed the law in Scotland as of November 2019 and the creditor now has the right to recover any unpaid parking charges from the keeper of the vehicle.

    You friend is wrong. Definitely. 

    Whilst the Transport (Scotland) Act 2019 was enacted, the part about 'keeper liability' is effectively dormant at the moment and will only be fully in play once there is a single appeals service and a regulatory framework, currently being worked on by the MHCLG, which Scotland intend to adopt. 

    ...unless they change their minds and never implement keeper liability.  It's not too late to try to change minds.

    Dear Umkomaas,
    I'm sure I read one of your comments in a previous post (March 2020) whereby you stated 'keeper liability' in Scotland had not come into force yet, but it was on its way. I've now been advised that it came into effect in November 2019... can you please confirm if you've heard anything to the contrary?

    That's good - what's your friend's background and knowledge of the subject?

    South of the border we have a guy called Bob the Gob who operates in many public houses here dispensing half-informed information. I didn't think that Wee Knickerla would allow him to travel north, given the lockdown restrictions. 😄
