Completed IVA - Now receiving debt letters

Hi, I need some advice.

I had an IVR from 2007 - 2012, it was successfully completed. Today I've had 2 letters from a debt agency saying that they have bought my debt and they are now seeking payment. I called them to find out more information and the debt is from 2 credit cards, which were part of the IVA. I've told the debt agency about the IVA and they've said that I need to provide proof but I no longer have any information relating to the IVA or it completing, the details were lost when I moved house.

The IVA was with Debt Free Direct, but they closed were taken over by another company, Aperture which I believe also closed.

Can anyone help and give advice on what I can do to resolve this?

    Number one rule, always keep your paperwork.
    There are always some chancer DCA`s who buy written off debt from an old insolvency hoping to cash in on someones ignorence, it should be banned this practice, it really should.

    However, luck is on your side, since the debts in question have not been paid or acknowleded by you in the last 8 years, you have another defence here, the limitation act 1980.

    You should write to the DCA`s concerned, advise the debts were settled by means of an IVA that ended in 2012, but even if that were not the case, these accounts would now be statute barred under sec 5, limitation act 1980, as no payment or written acknowledgement has been made since that date.

  • sourcrates I've turned my house upside down looking for the information relating to the IVA, but it's disappeared. Thank you for the information, it's extremely useful and I'll certainly follow up using the information you've provided.

    You can ignore these letters, the debt is 8+ years old, they are hoping that you pay them something for their 1p to the £1 for the debt they bought.
