    Update

Weve just had a phone call to say the DM have finally accepted that the money hubby receives is long term sickness pay, as he is still employed by the company! Only took 13 months!

We did contact our MP two weeks ago, so I suspect this may have moved things along....

It’s a massive weight off our shoulders, and I’m truly grateful for all the advice and assistance I received from this forum

I'm sure it's entirely coincidental that you got your MP involved recently.  Yeah right!  I'm just pleased to hear you have a resolution.

Good news! I can't begin to imagine how stressful it must have been for both of you, I would have been worrying about overpayments and all sorts of things.

Getting your MP involved is one of the best ways to speed along a resolution. Letters from MPs are given one of the highest priorities by benefit offices.

Thanks Robbie. It’s been awful. We were thinking we would have to sell the house. Such a relief to know it’s all over. Just wish they had listened to us in the start but hey ho....

That’s well worth knowing. It seems to have done the trick in our case!

Thanks for all your help, very much appreciated.

Great it has all worked out for you Targaryan, a lot of worry lifted off both of you. :)

On a slightly different note for anyone who has replied to your thread (as I myself have a occupational pension from late 90's and was on Incapacity benefit continuously from that time, and now receiving ESA (always has been contribution based).

Nothing was deducted or is being deducted from the ESA as I fall into that before April 2001 rule.I also get ESA transitional protection, regarding occupational pension and also ESA itself.

I know the transitional protections  for ESA was to end in April 2020 but has carried on.

My question is, does anyone know about the occupational pension transitional protection as I haven't heard anything, or is there a Government ruling on this that might affect me?

    Many thanks for any advice.

Very pleased it ha# been resolved for you. As explained in this thread, the rules aren’t that complicated and DWP really shouldn’t have taken so long to sort it out.
Information I post is for England unless otherwise stated. Some rules may be different in other parts of UK.
