DCBL parking eye threats

Hello everyone. 
Please need an advise.
I went to a gym on early sunday morning , June last year. Bought a DAY PASS from the gym for £8 and parked my car on the retail car park where this gym is located. Honestly didn't see no signs as it was foggy and I used to live in that county and was full member of that gym which the car park used to be free prior to me moving out of the county , so it didn't occur to me that it is now regulated. Anyway less than two weeks I received a letter from parking eye that I overstayed by 20 minutes and now must pay. I printed a copy of my DAY Pass for the gym to show I was a paying customer and have also paid to use the gym for the day. They rejected it. I phoned the gym but they didn't want to get involved. I appealed to Popla they rejected it. So I decided I will try my Luck in court. But heard nothing from parking eye till a year later. Now I received a letter from DCBL stating I must £185 or they would recommend their client take me to court . I know they can't enforce this unless they actually take me to court and if I lost. Has anyone been in this kind of situation? What do you guys think. I'm considering trying my luck in the court of law, is that a good idea?

    You'll only be able to try your luck in court if ParkingEye take you there. It's been our experience that where PE pass cases over to debt collectors, they do not progress to court. PE are more than capable (having two in-house solicitors employed) to initiate their own court proceedings, they don't need DCBL!

    How long do DCBL give you to respond to them? 14 days?
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    If the gym won't get involved , you only have 2 choices , pay in full , or court !!

    Only the parking company can issue a court claim which if it's PARKING EYE is quite common , typically for £175 , not £185

    But it's unusual for dcbl to be involved with Parking Eye cases , so something different is going on

    Ignore DCBL when they write to you about ParkingEye PCNs. 

    If P/Eye want to start a claim they will do so themselves without adding false sums of money on top.

    I guess that DCBL have not yet woken up to smell the coffee that PE are just using them  ???

    Hi Ralph, phoned the gym few times as I have even spoken to people who had this kind of problem on Tesco car parks and they had their tickets cancelled because they were paying customer and tesco stepped in but gym has refused to help . Thanks I will try and find out who the landlord is.

    14 days is just a debt collector letter , dealt with in the 4th post in the newbies FAQ sticky thread near the top of the forum

    Dcbl are powerless , just file their drivel !!

    If Parking Eye wish to issue a court claim , they will do so themselves , for £175 usually

    If they are asking dcbl to harass you , it's because they have an issue somewhere

    Just ensure that you have copies of all paperwork regarding this , email a SAR to Parking Eye if necessary

    It's just a debt crawler letter.  Probably the one with the 'Can't Pay? We'll take it Away!' logo to mislead you.

    Nine times out of ten these tickets are scams, so consider complaining to your MP, sometimes it can lead to cancellation.,

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and darfts have beenopened for publc consulatation,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, under new legislation but until this is done you should still complain to your MP, citing the new legislation.
