Barclays Addition Account

I opened a Barclays Addition account back in 2003 and i was paying £25 a month for things like mobile phone insurance and car breakdown cover. I never once claimed on it and i cancelled the £25 fee in March 2014 although i still have and use the account. I have tried to claim this back from Barclays and they sent me a letter saying that as this was more than 6 years ago they will not allow me to claim it back. Is this right? Can they do that? Will i have to go to the financial ombudsmen to get this resolved?
Any help will be much appreciated

    They’ve correctly applied the time bar so the FOS won’t overturn it.

    on what grounds did you try to complain and get a refund?

  • i found out recently that i could claim and i said to them that i was told the only account available to me was the additions account

  • Banks have been sending out letters for years telling people about the account cost, benefits and advising of free alternatives, the first time they sent one triggers a time bar clock of 3 years from when you could reasonably have been expected to know you had reason for complaint (separate from the rule of 6 years from when you took out the account). Closing the account also triggers the 3 year rule as closing it would show you knew about it and took action to cancel it. As you opened the account in 2003 you fail the 6 year check as well so they have correctly applied a time bar. The FOS cannot (and will not) overrule that as its a matter of law.
    Most packaged account comlaints fail anyway as they are opt-in in almost all circumstances and do offer benefits for your money, they aren't a problem product unlike say PPI or CPP
  • Just because you did not claim does not mean that you were not covered.
    If you had a reason to claim but chose not to do so or bought alternative cover again your prerogative but it does not make it missold.

    I haven't claimed on my life assurance but it doesn't mean it should be refunded.

    Yes.  You are timebarred using the 3 and 6 year rule.

    The FOS wont look at your complaint unless the timebar is incorrectly applied (and it seems is is being correctly applied as its 6 years from the purchase and more than 3 years from being reasonably aware of an issue - 2014 was more than 3 years ago)
