After two years of no contact, my missus had a letter today from cap quest saying she owes £418 of debt relating to an old O2 contract. This debt has to be more than ten years old as we have been together thy long and she hasn’t had any debt since we have been together.
looking online it says a debt can be statue barred if 1 of the following has happened:- Have you acknowledged the debt is yours, in writing?
- Did you make payment towards the debt?
- Did court action for the debt begin?
She hasn’t acknowledged the debt is hers, she has never made a payment towards the debt (unless paying the phone bill some of the months of the contract counts?) and there has been no court action. We believe this may have been from her x boyfriend having a phone in her name but cannot prove this.
would this be considered statues barred? If yes, is there a letter template I can use to send to them.
thanks

Capquest love to chase old, statute barred, or otherwise unenforceable debts.
