Counterfeit Amazon goods

I purchased a Phone from Amazon from an approved by the brand seller in 2018 and recently I had an issue and went to the manufacturer to see if it was under warranty as it was 4 days short of 2 years owning it only to be informed that according to the IMEI number the phone is a counterfeit, though a good one as I thought it was real for nearly 2 years

 After lots of back and forth with Amazon, they have agreed to refund me even though they claim they do not sell counterfeits and claim the manufacturer are lying.

 I am aware this an issue with Amazon my ex-partner worked in a warehouse for a while and in some cases, all the stock from all the different sellers are kept together and the picker just pick off the pile and the stock is just adjusted off the seller you purchased from inventory

 They have arranged a collection with Hermes who didn’t turn up and Amazon then cancelled the return.

 Once again a lot of back and forth and they have booked a new collection and once again no collection and the return window they set has been and gone due to waiting on the collection.

Amazon is now asking me to arrange my own courier at my own cost.

 What are my rights when getting a refund on counterfeit goods.

    It would qualify as "not as described" so you'd be entitled to a full refund (or replacement) and shouldn't have to bear the postage costs.
  • If they are giving a full refund of the cost price then my opinion would be that having to pay for the return costs isn't a bad deal.
    Legally, they could refund and deduct a % percentage for the 2 years use you have had from the phone so a cost of somewhere in the region  of £8 to £10 ( for RM Special delivery) is very little to pay for 2 years good use of a phone.

    I assume you were told this by someone who was in the first day of their new job and took absolutely no notice of such nonsense

    Makes no difference who it was really as they all toe the policy line.

    On a side note though you will find yourself without an Amazon account, they don't like this kind of refund after 2 years.
  • I'm not surprised Amazon are fighting this - trying to return a phone after 2 years and claiming its counterfeit is very suspicious. Surely if it was actually fake it would show in the operation of the phone? Last time I checked, counterfeiters don't make perfect working copies of branded phones - it's really obvious when they are fakes due to the software as much as anything. What phone is it?

    As a similar tale, we last bought from Amazon double-digit years ago after a similar episode. A pair of branded hair-straighteners bought from Amazon went faulty within a year and turned out to be fakes. Amazon were uninterested until Trading Standards got involved and we claimed back via S75.
  • UPDATE
    Amazon agreed to send me a returns label and then Hermes lost the parcel  :/ Amazon could see it was returned so refunded me.

    The next thing I purchased from Amazon was supplied with parts missing so going through the whole returns with Amazon again making me lose confidence with them but I got my money back for the counterfeit phone which is good
