pip review

Husband had high DLA  under the 50meters rule moved over to pip reduced to standard. Would not chance to appeal as a lot of people at that time were losing  the higher rate. Now he was due to review this in March 2021, and would have had the forms before to fill in. We were hoping to review the mobility  at the assessment as he is now at the 20 meter's rule as he has MS and is not good with legs. 
Today we had letter from DWP saying due to Covid 19 they are extending his award to dec 2021. But he is going to be a pensioner of age 66yrs in march.  Reading the rules for  this i am confused if we will be able to be awarded this higher in dec because of his age. if we leave it to then. Should i before he is 66ys put in for a change of circumstances and hope it is reviewed upwards. He has standard care. I know they look at the whole award but  if some one can explain the age and pension rules i may take the chance to report  the change before his revised award comes around.  Thanks.

    I'm not sure if PIP mobility can be revised to a higher rate once the person turns 66. Hopefully someone else will know for sure either way. However you can instigate a review at any time by reporting a change of circumstances. But be aware that all of the existing claim can be reviewed.

    Once a person reaches state pension age it's no longer possible to claim the Enhanced mobility part. Whether you report a change of circumstances is entirely your decision.

    I agree with this as the general understanding of the rules. There is an argument that this is actually incorrect and an ward can be revised upwards anyway, see https://www.rightsnet.org.uk/forums/viewthread/16308. However if I was OP I would be inclined to raise the issue before pension age.
    In practice the timing is only going to be about 6 months different. If OP wants to raise it before pension age they will need to do so in late February, early March. If the existing award runs out in December 2021 DWP would probably send out renewable paperwork in September anyway.

  • In September this year I had I had a letter from DWP extending my PIP to October 2021.   Today I  received my review papers! So much for extending.  It maybe you may find the same? Shirley

    An extended award certainly didn't mean you weren't still due your review.

    Note - new regulations have been made which now prevent a mobility award from being revised upwards after pension age is reached. This was the policy intent but there was a loophole in the regulations as identified in earlier post

    An update on above discussion, be it later, In the end i did not have to report a change as small review papers sent out  in January.  Today received news husband been given enhanced on care and mobility, was not expecting care uplift and concentrated on his worsening mobility.  Olso it wont be looked at again  till 2031 Whoppee no more assesments thank goodness.
