Car warranty

Good evening I purchased a ford focus on August the 26th the  car had a major fault on the 25th of September needing a refurbished engine the showroom wont give me a refund because I am one day over a refund have offered buying the car back for 3 grand I played 5700 or put the 1000 clam on my 3 month warranty to a engine with me paying the rest they start at 2400

    I assume it was a used car you purchased.
    What was the fault that required the replacement engine?
  • What date did you first request a refund?
    If it was the 25th September then legally you were still within the 30 day right of rejection.
    This is because the 30 days begins on the day after you have taken possession of the car so as this was the 26th August, day 1 is the 27th August and day 30 is the 25th September (up to midnight)
  • The car company are saying its starts the day you take the car

    Well they are wrong. The Consumer Rights act clearly states that day one is the first day after the goods have been delivered to transferred to the consumer.

    22 Time limit for short-term right to reject

    (1)A consumer who has the short-term right to reject loses it if the time limit for exercising it passes without the consumer exercising it, unless the trader and the consumer agree that it may be exercised later.

    (2)An agreement under which the short-term right to reject would be lost before the time limit passes is not binding on the consumer.

    (3)The time limit for exercising the short-term right to reject (unless subsection (4) applies) is the end of 30 days beginning with the first day after these have all happened

    (a)ownership or (in the case of a contract for the hire of goods, a hire-purchase agreement or a conditional sales contract) possession of the goods has been transferred to the consumer,

    (b)the goods have been delivered, and

    (c)where the contract requires the trader to install the goods or take other action to enable the consumer to use them, the trader has notified the consumer that the action has been taken.
