Hi Everyone, 
I purchased hotel accommodation for my parents through my credit card. Due to Covid they couldn’t fly to hotel. Hotel refused refund and credit card Under section 75 has now refused refund as I’m not one of the named Guests. They state the claim is not valid , this is what they mailed ........................ 

For the Section 75 rule to apply, you as the Primary account holder need to enter into the contract with the supplier ie the hotel booking but in this circumstance it is 2 x third parties on the booking therefore they have entered into the contract with the supplier not yourself hence the Break in chain.

Section 75 does not cover third parties as the Section 75 cover is a benefit for the Primary card holder plus any third parties ,however, it does not cover the third parties if not travelling with the Primary account holder as they are not our customer.         

I do not know where to turn, like so many others,

    It looks fair enough to me I am afraid.

    Also this probably should not have been a S75 claim in the first place even if you were going or not, why is it the fault of the hotel assuming the hotel was open and available to be used?

    As an aside, the bit in brackets in your thread title is irrelevant to the issue at hand.

    Agree about the bit in brackets - save that for the tabloids.
    They could be nuns with children and puppies as well which again is irrelevant and gives them no special rights.
    I do sympathise with the scenario, but emotion is never a good thing to have when dealing with these situations

    It would be an insurance claim if they had appropriate cover.

    As above, the credit card company are indeed entitled to reject a s75 claim if the cardholder isn't named on the contract with the supplier, but even if the claim had got past that hurdle, it would have fallen at the next, in that s75 requires the claimant to demonstrate breach of contract or misrepresentation by the supplier, and there's nothing in what was posted that suggested either applied here.
  • If the hotel was open and you / they couldn't get there, that's your problem and not the hotel's so you're due nothing anyway.
