Hello yes I notified them I was returning the item and they responded with the address to return the item to. My post office receipt shows this address on it with the tracking number which just says an update will be provided when the item is delivered.
i opened a claim with Royal Mail before reading what the time frame is and I am under 20 days.0 -
Does the legislation mean the seller should refund based on proof of delivery? I ordered on 5th September and returned on 14th September.0

1. Yes
2. They haven't received it yet.
Did you insure the item?0 -
No I didn’t insure it’s worth £160

If the seller should refund based on legislation can anyone advice how I should email them and whether to keep open the Royal Mail claim.
thanks0 -
Yes the seller should refund when you have proof delivery. However you currently do not have proof of delivery.Help1234 said:Does the legislation mean the seller should refund based on proof of delivery?1 -
Keep the claim open, if return has been lost in the post then RM is your only hope.Help1234 said:If the seller should refund based on legislation can anyone advice how I should email them and whether to keep open the Royal Mail claim.

I just wanted to provide an update - I contacted Royal Mail and have received a letter in the post saying they have investigated this and can see they have let me down and subsequently enclosed a cheque for the value of the product. Happy with the outcome.
Thanks for all your help.0 -
Not that it matters in this case as the OP has now been refunded but the relevant legislation makes no mention of delivery of the goods.noitsnotme said:

All it states is that the retailer should refund within 14 days of the consumer providing proof that the goods have been sent.
Even if they are not received, provided the CCR right of cancellation applies and the requirements for this have been complied with then the retailer is still legally required to provide a refund.1
