HOLIDAY PAY

while on furlough I was paid the 80%  which included 3 days at Easter which should have been holidays.
Last week my employer paid me the other 20% to use up these holidays. Can they do this.

    Yes, I believe they can.
    Indeed, I believe it was the correct process that holidays taken during furlough to be paid at 100% so the employer is correcting a wrong.

    Its up to you if you really want to kick up a stink about this if your job is at risk.

    So you had agreed to take the days at Easter as hols - and decided this around Easter?

    It depends. If the contract of employment provides that bank holidays are to be taken as holiday, no notice is required as it would simply repeat what is already in the contract. Some employers provide for an extra day at Easter.

    It is quite reasonable that, at Easter time, the employer was not fully aware of the furlough rules and how they interfaced with holiday rules.  An element of understanding seems reasonable in the circumstances.
