Same solicitor as vendor

  • We are not legally bound yet - as PP said because the banks are taking so long with mortgages the papers are being signed often the day before or even on the date of entry or completion date. 
    With regards to what I want - well initially some advice as I have never experienced this before, it seems to be totally at odds with Law Society advice, and as PP stated I have no idea if the work has been carried out properly. If something had come up like flood risk, planning permissions, etc would they be as likely to highlight it knowing it could make the sale fall through, given they are also representing the vendor? Its a lot of money to spend with that doubt in my mind. The sale had fallen through already due to the previous buyer losing their job because of covid so Id assume the vendor would be very keen for the sale to go through.
    I feel like signing something saying I knew about the dual representation is wrong as I didnt know. In fact looking over all the previous correspondence Id go as far as saying they have been quite underhand and deliberate in NOT highlighting this to me. I've contacted my old solicitor to ask for advice, thanks to all who have tried to help. And yes obviously after all this I will be contacting the Law Society so it hopefully doesnt happen to anyone else. 
    My situation was different as we were buying in England.
    The SRA are very clear in their guidance about notifying both parties of any potential conflict of interest. In our case this pitfalls were not brought to our attention until weeks into the process (they forgot to send the relevant details to us). By the time we were told about the conflicts in detail, a major issue had been identified and brought to the attention of our lender. 'IF' all goes well, using the same solicitor can be very fast, however, the advice I received on here, and gained from the SRA informs me 'never' to go down this route again - ever !
  • I couldn't get hold of my usual solicitor today so asked what conveyancing work had been done so far. Was given a list and in it was told reports will have been ordered legal, coal authority etc. I asked for results of these to be told they didn't have them. I asked how we could possibly have ever completed tomorrow but wasn't given an answer. On pushing this point I was a sent a legal report for the current owners dated June 2020 showing warrants for sequestration etc and asked to confirm I was happy with it. As I'm not a solicitor I have no idea I thought that's what I paid the solicitor to do?! I have no idea what's going on now I feel I'd be better to ask another firm to take over the whole thing - does anyone have any idea if this would severely hold things up in terms of the mortgage etc?
