PCM Appeal rejected-No Popla code in letter


I will keep this short for everyone. I recently appealed a PCN for owner left site, to PCM. The appeal was rejected with an option to go to the IAS (which I've heard bad thing about). No Popla code was sent with the letter, will it be just a case of sending them an email to give me one?

You cannot appeal to PoPLA because PCM do not subscribe to that scheme.
It is not worth appealing to the IAS. Read the third post of the NEWBIES thread to find out why.3 -

So really my options are to:
Pay £60 fine or possibly contact the Petrol station franchise I was parked in, or has that ship already sailed?0 -
But you know all this from the NEWBIES thread, we hope? That's why it's at the top in capitals begging posters to read it first.
PCM are an IPC firm so no POPLA, no appeal worth trying, no fairness and no paying the darn thing, as that funds the next ones. The NEWBIES thread shows you a link to successful complaints where people have seen PCNs cancelled by landowners YEARS later. I've done that myself for someone 3 years later.
Of course you won't be paying it. That isn't an option for an upstanding member of society who did nothing wrong.
There is no risk as long as you tell PCM if you move house within 6 years and come back if you get a court claim (Gladstones PCM cases are all over this forum and 99% won, since 2016. A TASK FOR SEPTEMBER - NB: this will take an hour or more to go through each section, and to do BOTH consultations:
The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms. Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.
You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

Please complete comment on all sections if you have a view, remembering the vision of the Knight Act is to end extortionate parking charges. If you agree with us, the added fake 'debt recovery' costs are just double counting the cost of letters and MUST GO, along with the robo-claim legal firms.A Speeding fine is £100. A Local Authority lower rate parking penalty is £50. Which do you think a private PCN should be like?
HOW TO DO THE SUBMISSIONS:
Responses into the PAS 232 and MHCLG framework documents are not completely straightforward:On the MHCLG response, you have to answer the questions on a 1-5 scale from strongly agree to strongly disagree, and then put some commentary. No way to upload documents or alternatives.
On the PAS 232, you have to click on each clause and sub-clause to put your comments, and a suggested rewording of their draft. You can see comments which other people have written!
But, when you click ‘submit’, a message pops up to say your comments have been received, but that only applies to the particular clause you have just addressed.
You have to click ‘submit’ separately for each individual clause response.
Some people will be caught out by this but can revisit it and add further responses up to 12 October.

Any "owner left site" claim is going to struggle in court imo, it may well go against the Tt&C of the CRA 2015,

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and darfts have beenopened for publc consulatation,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, under new legislation but until this is done you should still complain to your MP, citing the new legislation.
