On most things from LM such as changes to flights, alternative hotels etc they say you have 24hrs to accept. If we hear nothing back we will assume to have agreed. They said similar for the cancellation figure, only valid for 24hrs. Can they hold you to that?0

Paulcarr... Not sure, as you cancelled in August, if you need to worry about changing flights or alternative flights. Just look at the terms and conditions of cancelling when you cancelled and work out how much you are owed/owing based on that.0

Did you decide to cancel (and notify them of this decision) before your hotel announced it would be closed? If so, calculate (according to the T and Cs that you agreed) precisely what you should pay for cancellation on that date and offer to pay them this amount. That is the maximum that a court would order you to pay them, and if you can show that you agreed to pay this amount then the judge would order them to pay any legal fees.

I’d be interested in hearing what address, contact details they give to the court, so I can take them to court!0

Presumably the address in Switzerland that is listed on their website, and their ATOL and ABTA memberships? How you take a Swiss company to court I've no idea.Nebulous2 said:I’d be interested in hearing what address, contact details they give to the court, so I can take them to court!0 -
He's only a £100 down but into them (allegedly) for a monkey - he only paid the deposit and sensibly cancelled his card to prevent them taking the balance of what was effectively a cancelled booking by virtue of the FCO change in advice from the time of booking. Unfortunately he's not declared if it was a package or not !!! - actually he's disappeared off the face of the earth - sod him !!0 -
There has been some discussion about that. I don't think you can take a foreign company to small claims. There is a UK registered company which they refer to in their documentation and use to collect UK payments, which is:-bagand96 said:

I sent a physical LBA there but didn't receive a response. If I served papers there it is very likely they would claim I had the wrong entity. So it would be interesting to know how they represent themselves to court.
