hi hi we booked a big house in Scotland and there is a big group of us ( 17) all stated at the time of booking and all names had to be passed over. It is all paid for and we are meant to be traveling in October there is 5 different households. I have contacted the place and they are saying as they are open they offer no help and we should just send one family. I would have been happy with a voucher so they keep there money and we can boom another time but they don’t want to do that and say they don’t need to legally. Someone told me as the booking was for 17 and they new that, that as the terms have changed they have to refund under “ frustrated contract“. Can anyone give advise ? There t&c say unless the house is closed they give no refunds.

Honestly? I don't think you have any claim for a refund from the owners if the house is open and no local lockdown at the time. This is where insurance would kick in but it is highly unlikely that you have all taken out insurance. Very annoying but legally not a lot you can do other than send the biggest 'family' who may (or may not) be willing to pay a little extra to help those who can't go? The best scenario is that restrictions are lifted by October (well we can hope?) Sorry, not an answer you wanted no doubt.

Different surnames doesn’t mean different households - I have 3 different names under my roof and a student flat could have 7 or more and still be one household.Unfortunately they’re correct, the restrictions aren’t of their creation and it’s not their fault you’re a large mixed group.0

Ask whoever told you about the 'frustrated contract' for more information since they know about it. It would probably mean going to court.0

Interestingly, the only time I can remember ever seeing ‘frustrated contract’ was on a thread here, where a company letting holiday homes in Scotland was using it to refuse refunds. Search for LHH Scotland.0
