Section 75, am I eligible?

Hope someone can help.

Booked trip back in feb to New York for sept, at the same time we purchased 2 ‘New York passes’ - essentially this is a pass that covers several attractions whilst there. 

Around May we received an email from virgin giving us the option to take a credit for our flights, we took this.

I contacted the New York pass for a refund and they advised it was a 30 day money back period, so a big fat no! I’ve attempted a claim via my travel insurance, they rejected it. 

We have contacted the cc provider and suggested a section 75. They told me as the New York pass had fulfilled the order there was no case. Is there anything else we can try or do we have grounds for a push back to the cc provider?

any info would be appreciated

    The pass is still valid - it is not their problem that you can't make use of it.

  • raise a complaint with your travel insurer and you can go to the ombudsman if they reject. How much money are we talking about and what is your insurance excess?
  • The passes were just over £300. Insurance originally said to me the excess was £50 per person. 
  • The insurance rejected the claim on the grounds that we ‘cancelled’ our trip more than 28 days before the intended trip date.

    You need to inform them that Virgin cancelled your holiday not you (if indeed that s what happened).
