NCP parking fine

My son has received, at my address (where he doesn’t live), an NCP parking fine. The date is for April 2019. He has had no letters prior to this letter arriving!in September 2020. This letter is from a legal debt recovery company. Where does he stand with not receiving the first letters regarding the fine. He has no recollection of this fine or of when he was meant to have been parking at this car park. It is possible he parked there but how does he find proof he did and where does he stand that this matter appears to have been escalated without him receiving the initial warning letters.  He only has ten days in which to action things now before they take it to court. I have had the letter for a week now and am panicking about what to do. He must pay it if he didn’t pay in the first place but it is such a long time ago and he is unable to remember if he was even there. I appreciate any support or advice. Thank you.

    This is not a fine, this is an invoice from a scammer, possible an ex-clamper for compensation for the damage they allege they suffered as a reslt of your dastedly behaviour. Pay them not a penny unless a judge orders you to.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and darfts have beenopened for publc consulatation,

    Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, under new legislation but until this is done you should still complain to your MP, citing the new legislation.

    If your son is the registered keeper of the vehicle and it is registered to your address rather than his, then there could be another fine on its way - this time for up to £1,000 from the DVLA for not updating his address!

    Your son needs to deal with this NCP claim, it's not yours to deal with.  But, who has sent the letter and how many days in total did it give for response (not how many days left) and were a number of information leaflets and a financial questionnaire enclosed with it?

    Debt recovery company; ten days to deal; court action!  Debt recovery companies cannot initiate court action.  Read the NEWBIE sticky fourth post, be  advised, be knowledgeable, be calmed.

    He must pay it if he didn’t pay in the first place.
    No, he mustn't, and there is nothing to assume he failed to pay. 

    He must do what the 2nd post of the NEWBIES thread tells him.  Reply to the solicitors giving his CORRECT address for service and saying he is seeking debt advice but wants to see all evidence as he knows nothing about this.  Also, when emailing the PPC for the SAR (all explained with a linked example, in the NEWBIES thread) he must also tell the DPO of the PPC, the correct address and ask them to erase the old address.
