Parking fine for McDonald's Tankersley

I haven't been able to see my mum since Feb due to covid. Her partner vulnerable and I work at school. She lives in Greater Manchester which has been locked down for a number of months and I live in Nottingham. I decided the only way I could see her was to pick a halfway point. So I chose McDonald's Tankersley a few miles of the M1 near Sheffield. She arrived early and we had a coffee and catch up. I left a bit before her. She recieved a parking fine for exceeding 90 mins stay. I never saw any signage when I parked. I think I left before 90 mins but she stayed after I left to use the toilets.
So what was a lovely chance to catch up now has a sour taste. I emailed the Macdonald's. They said if I can provide the number plate that it might get overturned and the company let so many off each month but they can't promise it.
Is that enough or should she try and appeal. I know she must not say she was the driver but apart from that is there anything else we can do. I cant return to the site it's over an hour drive away for either of us, hence why we picked the spot for meeting up.
Thanks

    Which parking company?  MET?

What's the date of the Notice to Keeper (NtK) - first letter received
What's the date of the parking event?

You've made the right first move in getting McD's involved (Plan A), but you need a backstop in case they don't deliver a cancellation, so you need to read the NEWBIES FAQ sticky and prepare for Plan B.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

  • I am finding out the company
She got the letter yesterday and the date it happened was the 9th September so it's come just over a week later.
Do I start an appeal now or wait to see if McDonald's can help. If I do appeal do I plead for sympathy or does this imply she is guilty even if I don't say she was driving. Do I state that signage wasn't obvious. As I can't go back to the site I can't check.

THE KEEPER WAITS FOR MCDONALDS TO GET IT CANCELLED !!

but not too long as the appeal in the newbies thread must go in by say day 25 following the date on the postal notice, as keeper, with the blue text template

no blabbing about who was driving , to anyone

she uses the royal WE if talking to mc dees or anyone else , WE were patrons of your restaurant etc

    no "MY , ME , MYSELF & I"

You know what to do, because the NEWBIES PLEASE READ THESE FAQS FIRST thread (top of forum) tells you.

If you want to hook this away from Mum & partner then do the appeal as Mum, but giving YOUR POSTAL ADDRESS.

    Same reasoning as this one:

    https://forums.moneysavingexpert.com/discussion/6192696/smart-parking-help#latest

Exact same reason, protect a vulnerable person so that YOU see the letters, not Mum.

Push that complaint FIRST though, but don't miss appealing as Mum, giving your address, WITHOUT SAYING WHO WAS DRIVING, OBVIOUSLY...(newbies thread explains all).
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Nine times out of ten these tickets are scams, so consider complaining to your MP, sometimes it can lead to cancellation., i

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, and darfts have beenopened for publc consulatation,

Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, under new legislation but until this is done you should still complain to your MP, citing the new legislation.
