    It’s not really right that they did this, but if you just have your son pay you back then you are all square.

    Your son does plan to pay, I assume?
  • 1. Why was you returning your sons hire car?

    2. Assuming that you were covered on the rental agreement for insurance. Why was you not returning it with the correct level of fuel in it? Could this also have been you fine for running a Red light or Speeding?

    3. If you hadn't given them your phone number who did? Your son? Did they guess?

    So are you not going to ask your son if he did in fact commit the alleged traffic violation? Or do you normally just bail him out?

    Yes he would have paid had he known. My son could pay me but how does that stop Enterprise trying to get more money from my account. I only paid for petrol .

    He had no idea. He hasn’t received any paperwork from them. This isn’t a bail out. I merely returned the car for him.
  • What type of card was it?  Best to go to the card issuer and say it was an unauthorised withdrawal and you did not authorise it.   Then you should get all of it back.
    It was a visa debit. I will contact my bank and explain, thank you

    Yes that’s quite true ... that was the case for the petrol but that shouldn’t then give Enterprise the right to dip into my account as a when it pleases them. I never authorised that.

    You need to get the paper work off enterprise pronto and check their t &c about what it says about paying these things (this is important)

    But yes as enterprise had no right to take money from a third party to the contract between themselves and your son they are on very shaky legal ground , firstly I would ask your bank for a charge back and at the same time be issuing an lba for your money bank and an apology 
    They just debited this amount - no paperwork issued. So my son had no chance to appeal. I think they may well have tried his account then mine.

    Ask Enterprise for proof of the traffic violation offence (if your son is disputing this). Once received and if your son agrees, then ask your son to pay you and move on. Lesson to be learnt from this: ask your son to take more responsibility next time.

    Enterprise have the right under the contract to recharge penalties received.
    They do that to the card given to them on hiring... In your son's case, that card was invalid - but he gave another card. Or, at least, that's what they believed. They shouldn't have even debited the petrol from your card, because they shouldn't have been talking to you about his hire car in the first place.

    The easiest way to resolve this is for your son to simply repay you.
    If Enterprise repay you, then your son still needs to pay them. We presume he plans to do so...
