Highview Parking ticket got to debt recovery agency



2. My partner parked for a bridal fitting for 3 hours in a 2-hour area in a retail park. She didn't realise but got a parking ticket. We are pretty sure signage was fine. She got a fine. Following the advice on this forum, we complained to the shop. After about a month, they sent through confirmation of her appointment and their verbal instructions were "send this to Highview and they usually cancel it".
3. She didn't. I realise this was silly but life and job got in the way. She has got a debt collection agency onto her. She can't appeal it because it says 'contact the debt collection agency'.
4. I think she should send a letter to Highview attaching her appointment asking them to cancel it. But she thinks they'll send it back saying contact the debt collection agency. Given the advice from the bridal shop, we suspect that there is no point in hiding that she was driving.
5. I realise I skate over some of the stuff in the newbies thread. I have honestly tried to piece together the best strategy.
6. She's just annoyed that it is hanging over her and wants to pay the £155 that the debt recovery agency is demanding.

she is correct , she will be referred to the debt collectorsthere is no keeper liability with Highview, so as long as the driver is not inadvertently revealed to them they have no real caseyes the advice is good in the newbies threadIGNORE the debt collectors , they are powerless, nothing bad will happen from debt collectorsonly a fool would pay that £155. I certainly would not pay itHighview have 6 years to try a court case, a loss in court would be say £175 ish, so little more than what the debt collectors want , but we currently never see any Highview court cases, plus they fail to follow POFA , the law , so the keeper has no problem anyway, just do not reveal who was driving because it could be different if they knew who it wasideally the landowner cancels it , so that is the best option , its called plan A in the newbies threadthe keeper can send in the proof to Highview and attach it as a copy, stating that they as keeper have no liability but are informing them that the DRIVER had permission to park from the landowner, here is the proofit is important that this is worded correctly, no blabbing about who was driving, did I mention that ? lollastly , it is not a fine , its an invoice , a parking charge notice , or PCN , from a private company demanding payment and then passing it to toothless debt collectors to harass and stress out the recipient, trying to bully them into paying, do not do so and never call it a fine eitherno private company can "fine" you , or me , or the Queen, or Boris, not possible3

As above the debt company are on a no win no fee contract so they will keep pestering to try and get their rip off fee.Highview won't communicate now as they will be breaking their contract, just follow Red's advice, nothing much else you can do, keep the driver out of it, and it's not a fine.3

DO NOT say who parked the car.
The recipient of the PCN tells Highview that an occupant of the car was at a bridal fitting and as has been told by the shop to write to Highview to cancel it. Appointment evidence (copy) attached. Add that the keeper knows that Highview has failed to meet the requirements of the POFA 2012 and that the keeper cannot be held liable, so they must stop sending the keeper debt recovery letters and cancel this PCN now.AND - please now make a real difference - A TASK FOR SEPTEMBER.
The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms. Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.
You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.
And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
