New Car Sale Fraud?

I went to buy a new car yesterday on PCP. Viewing the dealer website I have realised I can get pretty much the same car quite a bit cheaper without part exchanging.

I realise if you agree to buy a new car sales are final, but I have 14 day cooling off period on the finance, however would then have to pay for the car another way. However I only signed the finance application.

I have checked the paperwork I brought home and the dealership have signed the vehicle order form. Its literally not my signature.

What can I do?

    Sorry, what's the "fraud"?

That you didn't check if you could buy it cheaper elsewhere before signing up? No, that's not fraud.

If you haven't ordered the car, then what's the finance application for?
  • Yes you have 14 days cooling off with the finance but that only a cooling off about taking the finance. You'd have to find the money some other way if you decided to cancel the finance. Sounds like buyers remorse rather than fraud so far.
  • I think the OP may be referencing the fact that the dealer seems to have signed the order form for him.

Well was Op at dealers at the time of the purchase & the paperwork being signed?

  • I don't think you're going to get out of the car sale over a technicality such as this - you agreed to the purchase and took possession of the car. The finance is merely a means to pay for the car, and as above if you cancel the finance you will have to arrange another way to pay. You could return the car to the dealership, but it wouldn't be "new" anymore so expect them to fleece you for selling back a "used" car. Probably just best to chalk it up to a life lesson of shopping around properly before you commit to buying something. If you were happy to pay the asking price before you found it cheaper elsewhere then it still can't be that bad of a deal...

Provided that you were happy with and agreed the terms and conditions of the sale at the time of that sale, there is nothing wrong with what the dealer has done as legally a signature isn't required. (How often have you made purchases in shops without needing to sign?)
It would be a different matter if by signing the dealer was attempting to earn extra money or to cause a loss to you as this would be fraud but in reality, in this covid situation, is it really any different to a postie or courier signing to say that something has been delivered to your property

Do you have the car, or have you ordered it? If it is ordered, why don't you ask the dealer if you can change your mind?
There may be a loss of deposit, or a fee to cover the dealer's expenses, if there are any.

What outcome do you want here? What is the problem? Your ordered a car on finance and they are supplying you one.
