I got a County Court Judgment (CCJ) by Vehicle Parking Service Ltd (VCS) in my credit score

Hi Everyone!
I have a 1 month old baby and we need to move house as this one is too small for the family. We currently live in a rented flat, but we got an agreement for a house and now I am in the phase of getting the mortgage. When it came to apply for the mortgage my broker and I realized that my credit score was low due to a year and a half old CCJ that I was not aware of.
This CCJ came from a parking ticket PCN with the rented car that I used to move from my old house to the new one, so the letters sent by VCS and the County Court Business Centre (CCBC) were sent to the old address and not forwarded to the new one, as they were provided the old address by the rental car. I have just been made aware of all these mess now and I do not know how to solve it.
Now I have a 185£ CCJ that I need to set aside or at least get as satisfied so I can try to get a mortgage with a lender. I have gone to the Vehicle Parking Service Ltd (VCS) website and paid the Parking ticket (PCN) using their automated payment service by phone. The fine was 160£ and I could not modify the amount to reflect the total amount of the CCJ, I believe the other 25£ are the CCBC fees.
Now:
How do I pay the rest 25£?
Does anyone has experience getting a consent order from VCS to get the CCJ records removed?
Will it be worth it applying to get the CCJ set aside?
How long will it take for the CCBC records to be updated and my credit score to reflect the CCJ as satisfied?
I am finding this very challenging because Vehicle Parking Service Ltd (VCS) is not responsive at all and I need this sorted asap as I need the mortgage in order to proceed with the purchase. The vendors are eager to sell and I am afraid they will back up and go to another buyer that can purchase the property faster. My little baby really needs a bigger house and this is hurting the whole family...
Every little help would be welcome and appreciated,
Thanks!

Oh no.  Oh no.    Why didn't you come here first?  That makes your position worse now.

paying off the CCJ wont get it expunged from the record at all, its too late for that , all paying it will do is mark it as satisfied but it still stays on your credit record

ideally you need a set aside which costs you money and will take weeks or months to achieve , its £100 for a with consent set aside and £255 for a contested set aside, but paying them money does make your position worse so should not have been done , be it £160 or £185 it wouldnt have cleared your credit record in either sum

set aside advice for a CCJ is in the newbies thread at the top of this forum

you need to act fast whatever route you take

Please tell your MP your story, many/most of these PPC CCjs are isuued without due diligence.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,

Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.

Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

You never know how far you can go until you go too far.
  • Thank you all for your responses.
I paid the PCN as my mortgage broker told me so. He stated that if we get the CCJ satisfied we would have more chances of getting a mortgage approved.
Would it be possible to get the CCJ set aside after it has been satisfied?
I am completely lost and hopeless, I have always paid my debts diligently and this came out of the blue in the most important time of our lives.
  • Yes, of course you can still set aside. Follow the clear instructions on the newbies thread, and read read read.

AND - please now make a real difference - A TASK FOR SEPTEMBER.

The Government is (this month only) consulting about a new statutory code of practice (CoP) and framework to rein in the rogue parking firms.  Read and comment on the draft CoP proposal and the enforcement framework consultation, and get everyone you know to do the same.

You will need to register to comment on the CoP and enter an occupation even if you are retired or a homemaker, but otherwise it is easy to navigate, and comment upon each section/subsection individually. You can save comments to edit later and or submit comments once you are happy with them.

    https://standardsdevelopment.bsigroup.com/projects/2020-00193#/section

You do not need to register to comment on the enforcement framework which can be found here. It has a link on page 5 to make comments.

    https://assets.publishing.service.gov.uk/government/uploads/system/uploads/attachment_data/file/913272/Code_Enforcement_Framework_consultation.pdf

At the very least, we say the parking charge level should be £50/£25 or higher level £70/£35, as per Council PCNs in E&W.

And we say the added fake 'debt recovery' costs are just double counting the cost of letters, and MUST GO because that is unfair and illegal.

Please be heard.  You can bet the hundreds of PPCs will be commenting.

No apologies for repeating this vital 'call for action' to consumers, on every thread this month!

  • Hi Community,
Quick update, there are lenders that would give me a competitive mortgage if I get the CCJ as satisfied asap, which are good news.
The bad news is that Vehicle Parking Service Ltd (VCS) is totally irresponsive even when if I have paid the parking ticket already using their automatic payment system. The litigations department does not have a direct phone line and they are just reachable via the email litigation@vehiclecontrol.co.uk.
I need to set the CCJ as satisfied and every time I call the County Court Business Centre (CCBC), they tell me that I could just get this sorted out with Vehicle Parking Service Ltd (VCS), but every time I send an email to Vehicle Parking Service Ltd (VCS) I get this automatic response back:
"Thank you for your email which has been received by the Litigation Team. This email is automatically generated; please do not reply to this message.
Please refrain from submitting unnecessary duplicate correspondence by only using one method of email, post or fax.

Does anyone know what does this mean? It seems to me that they say that I need to speak to CCBC, so I am just bouncing from one side to the other.
I have also paid 14£ to CCBC to get a certification of the claim set as satisfied. Basically they contact
Vehicle Parking Service Ltd (VCS) and ask them if the claim has been satisfied. If no response is given within 30 days they set the CCJ as satisfied and then email me with the status change. But the fact is I do not have that much time... :(
    Any help is really appreciated.
Vehicle Parking Service Ltd (VCS) is really taking families down hill, I do not understand how regulators allow companies like these treat civilians this way and still get away with it...

    Regulators? What regulators??

To help get this unregulated industry under control you really must follow the suggestions made by Coupon-mad in her most recent post on your thread.

You have no choice but to wait.

Tell the MHCLG and BSI about what needs to change and which firm has ruined your mortgage chances.

  • I can assist you to set aside the CCJ. This can be done via a consent order with £100 fee if you have paid the full amount or an application to set aside.  If you have never received a claim form, you can use CPR 13.2 (mandatory) or 13.3 (discretionary grounds).  If you still need assistance, do not hesitate.
