Possible Court Action with a displayed Parking Ticket


Just over 5 years ago I parked on private property and displayed a parking ticket. When I got back to my vehicle I had been issued a penalty.
Looking over the rules I had pressed the wrong button which should have been for Visitor's. The amount I paid would have been the same as the Visitor charge.
I explained that I had a ticket on my vehicle and I have proof of the signs being too ambiguous and a picture of the ticket being displayed.
The description is for - Parking Without Displaying A Valid Permit Or Ticket.
In my response to them should I include the evidence of a ticket and the signs or just state that I have evidence and wait for them to take it to court and what are the changes of a counter claim for my time dealing with this?
From those with experience what are the chances of winning this in court if it gets that far?

Have BW Legal added the so-called debt admin or contractual costs of £60? If so you could reply to them asking for their legal authority to do so. check out posts by @beamerguy like this one: -

Typical one, same as all the rest. Slowly reply to each letter asking for all evidence, and then when they acknowledge, say that you are seeking debt advice... this is all in the NEWBIES THREAD.

Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up later this year,
Just as the clampers were finally closed down, so hopefully will many of these companies, persistent offenders denied access to the DVLA database and unable to operate.
Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.
