I have dealt with a number of council PCNs where the ticket has been cancelled at the formal appeal stage, with the same appeal used at the not upheld informal stage...
Some even have the same person signing both appeal responses!!!1 -
Thanks all. I met several other visitors on the day that also had been unable to pay - one lady told me she'd tried several machines. Is it ever worth submitting (or threatening to submit) a FOI to the relevant department to try and uncover if there had been a spike in fines over the period in question? I'm pretty sure there will be others in the same situation.0

Please be advised that it is never possible for all ticket machines to be out of order in our parks.That is a ludicrous statement and untrue. All machines like this are very fallible and could simply be full or blocked with coins. This has clearly been written by a fob-off 'computer says no' numpty. I would challenge that statement now with another appeal, as well as planning to appeal formally at NTO stage.
I hope you are the owner of the vehicle? You can't risk an Excess Charge notice being posted to a lease/hire firm, or your company!
I am not sure if Royal Parks fall under FOI? Private companies don't but maybe Royal Parks do...?
If they do, ask for all records of machine functionality that week, and all repair/machine emptying/resetting records and the number of call outs and complaints received about any machines during that week.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Your assertion that "it is never possible for all ticket machines to be out of order" is disingenuous as I have proven (with evidence) that the machines I tried to use were faulty. It is unreasonable to expect visitors to try every single machine until they eventually locate one that is working - you have a duty to maintain ALL machines.
I've checked - Royal Parks do fall under FOI. I will incorporate your words in to my request.

I just wondered how you are getting on?I have a similar issue with Royal Parks however we did manage to pay but their machine didn’t issue a paper ticket to display in the car. They are also arguing with us that it clearly states a ticket must be displayed despite us proving with bank statements that we did pay at the date and time given.We have now sent another email
and are awaiting a Notice to Owner.0 -
