Hi guys,
This is a very complex situation I appreciate your time reading!
I have recieved a huge amount of pcns from smart parking ( 74 pcns to be precise! ) :( at currys car park. I was supposed to be exempt as I was staff at the time. An error was made by my management and not rectified immediately and this is why. I was firstly not aware my exemption was removed( again this was an error). So from August 2019 I was being fined every day by smart parking up until March 2020. However all the tickets were going to my old address Hence I was none the wiser and continued parking during my working hours. Eventually smart parking found my correct address and issued me a demand for payment letter. I immediately notified my manager and was like what is going on. He said my name was of exemption list and would be added back and assured me it would be dealt with. So just for peace of mind I appealed one of the tickets explained my situation and told them I was exempt. Even though they had recieved instruction to exempt me and told by my currys management to cancel these pcns they have denied this and taken it to debt collectors now. I am at my wits ends so stressed as the debt has accumulated to 11k. Theres so many pcns so many cases what do I even do now. I have appealed to popla but I doubt they will do much. Also because of coronavirus the store was closed for so many months and communication between currys and smart about this got delayed. This is genuinlely no fault of mine but I believe because of the balance this will be pursued further and I really could do with some advice. Iv called the debt collectors to explain they dont care and dont deal with with appeals. Should I just wait for court and judgement day to explain everything.
really appreciate any responses am actually loosing sleep and severe anxiety of this large debt :(
kind regards

This is a very complex situation...
No it isn't. It is very simple.

Should I just wait for court and judgement day to explain everything.
No. You need to get your employer to fix this.

...am actually loosing sleep and severe anxiety of this large debt :(
There is no debt until a judge says so.
  • I’m sorry to hear this, but KeithP is correct, you must insist your employer ensures they are all cancelled...

AS ABOVE , GET THE MANAGEMENT OR LANDOWNER TO SORT IT OUT ASAP AND GET THEM ALL CANCELLED !!

if necessary , email a SAR to the DPO at SMART parking to get all the documents , data and details

your employer was responsible for getting the exemption for you, it was beyond your control

and stop telphoning debt collectors, it wont help and will only upset you, no good can come of it as all they want is the figures on their letetrs, in GBP, nothing else will do, they cannot sort it out

so get complaining and get it sorted by the employer or landowner asap

    never phone the debt collectors

Complain to the BPA as well.  This week!

Do this by email to Steve Clark, and copy in your MP and ask your MP to alert the MHCLG who are currently consulting on rogue car parking operators.   Copy in your boss as well, and whoever runs the retail park (the landowner/agent, not the store).

All in the same email so they can all see what is being said and to whom.

    Have you read this?

"I am sick and tired of receiving emails from people complaining about the behaviour of parking companies, telling me that they will never again visit Perth city centre because of the negative experience they had when they had the misfortune to end up in a car park operated by one of these companies. I have received more complaints about one car park in the city of Perth than about any other issue. That car park is operated by the lone ranger of the parking cowboys: the hated and appalling Smart Parking—I see that many other Members are unfortunate enough to have Smart Parking operating in their constituencies. It has reached the stage where one member of my staff now spends a good part of each day just helping my constituents and visitors to my constituency to navigate the appeals process.

The BPA does not have the ability to regulate these companies and has shown no sign whatsoever that it is trying to get on top of some of the sharper practices. The BPA gives a veneer of legitimacy to some of the more outlandish rogue operators by including them in their membership, allowing them to continue to operate. The Bill will oblige operators such as Smart Parking to amend their practices.

Have you complained to your MP?

Were you a union member at the time?  If so, get them involved too.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
