CCJ during lockdown

Hello, I hope you can help me with a CCJ:
In Jan 2020, I had to hire a van so booked one at Heathrow.
Arrived at the car rental car park, into a hotel premises, found that I couldn't pay for parking at the reception. Left my car there and took a van as a lovely French lady needed help with her removal which was also donated to the BHF.
Later on, I couldn't pay the parking because the only machine accepting cards was off, so coins only.
Received PCN from PARKINGEYE in Feb 2020, I contacted the land owner and Resolver which resulted in no more letters from PE.
Moved house before the lock down, redirected the post but because of social distancing could not check old address regularly.
In July 2020, got a permanent address and updated DVLA.
Nothing arrived at the new address, but last week went to check mail at old address and found a CCJ.
Any chances to have it set aside?
Thanks for your help.

Yes because they didn't trace you , so similar to many other threads about set asides , see the second post in the newbies FAQ sticky thread , maybe trying for a with consent £100 set aside , before a £255 contested one

What do you need to know that is not already explained in the detailed CCJ Set Aside section of the NEWBIES thread, 2nd post?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Hello, my question is not about a wrong address but on how to ask the judge to set aside a default judgment given that I could not check my post at weeks old address because of social distancing and 'stay at home' govt rule.
Found no such a case in Newbies and faqs..
  • Did yo usearch threads? We have had at least 2 so far.

Papers were served to the wrong address , so that is the basis for a set aside , if you are going for a £255 contested set aside ? (You never said which of the two you are after). They should not have proceeded without tracing you and your current address , especially if you were there to be found

If you are asking about a with consent set aside for £100 then your query is irrelevant

It is not difficult to obtain a contested set aside when papers are not correctly served , but you must also include a defence so that a judge can see you intend to fight it afterwards (fight the original court claim). You claim it is not about the wrong address , you couldn't be more wrong , that is the crux of a set aside being granted. So yes it is about the wrong address

The rules on this changed a few years ago so feel free to read them

This isn't a legal aid forum , it's a consumer rights forum , so you won't find chapter and verse on the topic , read my signature regarding legal advice

So yes I believe you can get a set aside , but decide which path you require and act accordingly

There are plenty of similar threads on here with the answers to your questions , it is my belief that you have not researched the topic and are expecting one liner answers , in which case consult a lawyer like Martin Lewis would tell you to do

You have asked a CCJ based legal question on a parking forum , your question has nothing to do with parking at all , it's to do with legal court procedures etc , not a remit of this forum
  • when was the claim issued? Presumably there is a claim form at the old address? Or do yo umean a judgement in default?
  • Claim issued in June, people at old address didn't want to meet due to Covid19.
Dvla new address in July ccj received at old, inaccessible, address in July.
PE wrote that consent order is responsibility of its bailiffs...
Default judgement because of Covid19, any link?

No, but we had one like it where the person did get a set aside due to missing post during lockdown.

You really do NOT need a link or template, your case is no different than the usual 'wrong address' ones and you simply adapt the words to make sense!  That's what the other person did.  No idea who it was thiough, and no link, forget it, crack on. Same stuff as all CCJ set asides, just different reasons.
