Do EA have to put a house is under offer or Sold stc on their advert?

    Well...

    • Consumer protection laws don't allow the EA to say anything (or omit anything) that would mislead a consumer.
    • And the Advertising Standards Authority says that adverts must be legal, decent, honest and truthful

    So if the property isn't available, but the advert suggests it is available - maybe you could argue that it's a 'technical' breach.

    Perhaps a more serious breach if they're intentionally advertising a desirable property, in order to get people to phone up so that they can then try to sell them a different property.


    Or are you asking because you've had an offer accepted on a property, and the EA won't mark it as Under Offer / SSTC?

    SSTC / under offer doesnt really mean much.

    e.g. the seller may well say - keep marketing until X, Y or Z (even upto exchange)

    If the property is 'sold' and the buyer is proceeding it would seem daft for them not to, otherwise they're just wasting everyone's time including their own dealing with people asking to view.
    If someone has made an offer which the vendor would accept, but the buyer isn't in a position to proceed, then it would be quite fair for it to remain on the market in case a buyer in a proceedable position comes along.
