car finance

my son and his partner purchased a car 2 years ago on finance it still has 3 years to run, the finance is in my sons name. His partner has now left him and taken the car with her leaving my son to carry on paying for it. My question is can he hand the car back to the finance company even show he doesn't know where it is, or does he have to keep paying for it?

  • If he doesn't have the car, it'll be difficult for him to hand it back.  

    Unless he can knock up a replica and the company doesn't notice it's not the same car.

    Is you son still in any kind of contact with the ex, even via her parents / family? 

    He could advise her that he cannot afford to maintain the payments and she can either return the car to him (so he can return to the finance company) or take over the payments.

    If that does not yield the required result, he could inform her that he would then have to report the vehicle as stolen.  Who is the registered keeper?  Who has the insurance as the main driver?
  • if he tells the company where it is can he hand it back without the keys

    Pretty sure they would want the keys, the car and depending on the type of finance at least 50% of the payments made.

    They are not going to go chasing his ex on his behalf.

  • The car is technically owned by the finance company. If the finance is in his name, then he should be able to decide who keeps the car, him or her. If she refuses to hand the car back, he should report it to the police - it’ll be classed as TWOC. If he can’t afford the finance, then he should liaise with the finance company too. 
  • If it's on hire purchase, and in his name, then he is the legal custodian of the vehicle, no matter who is the Registered Keeper.

    He needs to report it stolen by his ex to the police.
