What is actually going to happen?

I am wondering if anyone actually has any idea what course this whole bank charge situation is going to take.

I know there is a 'test case' on Jan 14th 08 but as I understand it this is only to determine whether the UTCCR's apply to bank charges. So what happens then?

I, like many thousands of others, have a case in progress which has been stayed. I feel angry that I have paid my court fees for my day in court and that right has been denied whilst banks are allowed to carry on charging their fees and are in effect untouchable as we as consumers are no longer allowed to challenge them - there's democracy for you.

I have a few questions and would like some considered opinions please:

1) Once the 'test case' has been heard, what happens then?
2) When will claimants be allowed to continue pursuing their claims?
3) Could it potentially be years before claiming could resume?

There is a distinct lack of information about the possible outcome permutations that could arise once the test case has been heard - I am quite clueless as to what to do next - if anything?

    All valid questions and not sure there is anything you an do other than perhaps apply through the OFT as well as the ongoing case. Also lobby the MP to get charges stopped or set at a maximum as an interim step at least.

    See threads with recent comments - Agnes case - as to what might happen nextif you have not had a judgement made already. It looks as though the test case will just extend further the delays and go even into 2009 with appeals. Rest assured the banks will hold out for as long as possible while they can continue to raise charges as they do now.
    Sorry to be so gloomy but unless someone else has a briliiant new idea that is the status.

    i was just wondering when you can start reclaiming again? and when is the test case going ahead?i got my charges back from HSBC last year but now my bfriend wants me to do it for him.
    savings for 2012.. New year new me.. Going to save save save... and not spend spend spend. :rotfl:

  • Hiya everyone not been on for a while since i had my case stayed back in early november.
    Just curious as to what will happen to all that payed the court fees (mine were £120.00).
    And no matter how much i try to read all posts on here i'm no clearer on what happens next and how long we have to wait for an outcome.

  • the case is on the 8th Jan 08 i think . so just gotta wait a little longer
  • This has been posted elsewhere but think it worth reiterating.
    If you have to go with the stay get it unlinked to the test case outcome as that will keep pressure on the banks to resolve the test case early. The date on my stay is limited to 1st April 2008 when judge expects to then be able to go forward without constraints because the banks will have been shown to be obstructive, or case will have been resolved because of the test outcome whichever way the ruling falls.
  • WE had sent our 2nd letter to Barclays just before the announcement of the test cases and expected not hear about our claim of just over £1000.
    However we have now recieved an offer of £275. We have 8 weeks to either accept this sum or lose it!

    This time is almost up and I am not sure whether to:
    a) Ignore it and reclaim after the test case.
    b) Accept the offer

    Any advice would be appreciated

    You don't lose it. Tell them to bend over whilst you demonstrate what they can do with their offer & continue the claim through court. You will get what you are after once this test case farce is over & done with..

    And you may well be left with egg on your face if the banks win the case. It is going to court so no doubt better legal minds than the barrack room lawyers on here will decide the outcome.

    Although come to think of it I am not sure why they are bothering with the expense of a court case just come here and they will be told all they need to know.

    1) The banks should not be allowed to charge anything for their services, it should all be completely free.
    2) Why should I live within my income? The bank have plenty of money for me to access. Otherwise they wouldn't always site those ATMs over the magic money trees would they?

    If the banks win the case, then there is far more to worry about than egg on face. Such a result would mean it is no longer safe to buy goods & services in the UK.

    Firstly, it would effectively legalise penalty charges as long as you call them "service fees".

    Secondly, given the way that bankers have disguised their charges as service fees & re-worded all their T&Cs to introduce these new "services", it would also mean that companies would then legaly be able to force new services on their customers & charge what they like for them. Imagine getting a utility bill one month that is £250 more than usual & discovering that its for a whole bunch of new services that you never asked for or wanted. You wouldn't be able to contest it if a high court ruled in favour of the bankers in this case..

    Of course, it is ultimately up to the individual what he choses to accept, but 1/4 of the amount is really taking the Micheal and well worth fighting over in my opinion.

    Personally, I very much doubt that the "case" will be concluded at trial.

    I got a date set from Moneyclaim, which had a stay put on it.

    I just want to know what is happening, as Moneyclaim haven't refunded my money and I haven't heard any more about my claim.

    Are the banks brushing all of this under the carpet now ?
