The grace period is in the BPA CoP , January 2020 edition !! Clause 13 , it's been clause 13 for 8 years , download it and read it , it's definitely lower than 12 minutes !
The signs seem clear enough to my untrained eye and the driver failed to validate their stay on the terminal inside the church (because it was closed) , because it's not a pay and display car park so no payment is necessary , so clearly the contravention is an overstay on private property without permission from the landowner
The NTK was issued within 14 days and will comply with Pofa if you check the back of the NTK for compliance
The £100 daily tariff is the default daily tariff
If parking eye have a landowner contract and authority to pursue claims then I do not see any obvious legal loophole , meaning I see a slam dunk for the claimant0 -
One of the signs isn't from Parking Eye though (that photo needs the date and time embedded in it from the phone that took the image). A defence point in itself = confusion about who the alleged contract is with.
And 12 minutes is certainly OK during COVID, to try to use a car park where you know there are terminals, only to have to spend a fruitless 10 minutes looking to see if there are some terminals outside once it was noticed that the doors were locked, etc., etc.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Exactly , focus on the obvious arguments due to two conflicting signs , different companies , presumably old PTL and new PE
Also that due to covid restrictions it was more difficult to understand what to do and 12 minutes is not unreasonable in the circumstances and that the vehicle was not parked for a typical period of say one hour , an obvious breach if it had happened , but didn't
Focus on no landowner authority too
All this should have been done at Popla , with less riding on the outcome
The rest of the previous assumptions are incorrect , naive and irrelevant1
