    If you have a hearing date than you will also have a date for submitting your witness statement (WS), evidence and summary costs assessment.  You normally need to submit your bundle to the court/claimant at least 14 days before the hearing date.  If you submit a SAR now, the PPC has 30 days to respond.  Check your dates to make sure you will receive the data from the SAR leaving enough time to add it in to your WS.
  • Thanks for the reply, I don’t have a hearing date as of yet. I just got a letter telling me that it’s going through the small claims track and if I am happy for it to be decided on the paperwork but as Coupon-mad stated in the thread, I need to ask for it to be heared face to face.

    Good morning, so I have read the telephone hearing thread, then read it again, then read it for a third time without my daughter climbing all over me and this is what I think needs to be done

    1) I need to write to the court to say I DO NOT want the hearing to be done just on the paperwork alone and want a hearing via telephone
    2) I need to get all my paperwork in one bundle ready to email to the court so the judge has it in front of him for the hearing.

    Also going back to what RedX wrote on this thread a few weeks ago which is below
    “Email a SAR to the claimant parking company , to their DPO , to obtain all documents and pictures and data etc that are about you , attach copies of 2 recent redacted utility bills as proof of I D under the GDPR law”

    What is a SAR? And how do I word the letter to BWLegal Just so I can do this today but don’t want to sound like a amateur to BWLegal. I need all the paperwork from them as I have lost some as thought this was all finished with over a year ago.
    The ironic thing is THEY have a picture of the old sign on the wall which is illegible and I have a picture of their new sign which is much clearer and I want to use this as evidence so need it and BWLegal have it on file.

    Read the newbies thread for acronyms and Initialisms , I did emphasise this earlier

    Email is currently better than snail mail

    Emails can be dealt with by people working from home and following government guidelines , snail mail gets left , plus if delivery is refused you only have proof of non delivery , not what you want

    This process would be much easier if you do as you are told !! Lol

    Obviously.  Flipping heck it's also lockdown #2 so sending letters to court now is daft.

  • Thanks for sending me to the right place Redx. I found the template for the SAR so I will be sending a letter to BW Legal and Parking awareness Services as I don't really want them to have my email address unless they already have it!!!
    I will write a email to the CC now so will wait and see what I hear back.
    I understand that it can be frustrating for you guys and feel like you're banging your head against the wall with people like myself but this isn't something I do everyday and its all alien to me so want to make sure I get it right. All this is hugely helpful and I cant thank you all enough for taking the time to answer questions and help me out. And I can also understand why some people just give up and pay up as this is very much time consuming when you have a full time job and children to sort out. Its all just a unwanted headache and stress
