    With a Claim Issue Date of 25th March, and having filed an Acknowledgment of Service in a timely manner, you have until 4pm on Tuesday 27th April 2021 to file your Defence.
    That's over two weeks away. Plenty of time to produce a Defence, but please don't leave it to the last minute.
    To create a Defence, and then file a Defence by email, look at the second post in the NEWBIES thread.
    Don't miss the deadline for filing a Defence.
  • This situation continues. On 17th July 2021 I parked at Porthpean car park just before 7.00pm to find the payment machine not working, and no phone signal with which to pay by app. Having walked quite some distance away I got a phone signal, and paid for an hour's parking. We left 56 minues after we arrived i.e. less than an hour. Despite this Armtrac gave me a Parking Charge Notice, asking for £100, because I was parked for too long before making payment. I challenggd it, and have been through the Independent Appeals Service, and my appeal was rejected. I don't think the IAS (run by the International Parking Community) is independent at all, I think they work hand-in-glove with operators such as Armtrac. The adjudicator said he had some sympathy with the appellant (me), but nevertheless was rejecting my claim. While I could have refused to pay, and seen what happens in court, I'm sure I'm not the only one just to run out of energy, so I've paid up. But I am disgusted that their actions are apparently legal.

    . KBT Cornwall are claiming ... £60 "recovery costs"

    They have added what appears to be an extra unlawful amount for debt collection/recovery costs. Judges have dismissed an entire claim because of this. Read this and complain to your MP.

    Excel v Wilkinson

    At the Bradford County Court, District Judge Claire Jackson (now HHJ Jackson, a Specialist Civil Circuit Judge) decided to hear a 'test case' a few months ago, where £60 had been added to a parking charge despite Judges up and down the country repeatedly disallowing that sum and warning parking firms not to waste court time with such spurious claims.   That case was Excel v Wilkinson: G4QZ465V, heard in July 2020 and leave to appeal was refused and that route was not pursued.  The Judge concluded that such claims are proceedings with 'an improper collateral purpose'.   This Judge - and others who have since copied her words and struck dozens of cases out in late 2020 and into 2021 - went into significant detail and concluded that parking operators (such as this Claimant) are seeking to circumvent CPR 27.14 as well as breaching the Consumer Rights Act 2015.   DJ Hickinbottom has recently struck more cases out in that court area, stating: ''I find that striking out this claim is the only appropriate manner in which the disapproval of the court can be shown''.

    The IAS allowed just 4% of appeals last year and consistently average a woeful 5% upheld over the past 3 years so you had no chance.  It is absolutely a kangaroo court, based on the reports we've seen over the years.  Luckily it will be replaced soon.

    It's a shame you paid (there was no CCJ risk) and we wish you'd come here last month, in time to respond to the Government consultation because your evidence would have been useful to help shape the changes next year, when private parking becomes regulated by Government.

  • We had to pay the parking fee with cash as the mobile paying was not working in the car park somehow, and displayed the ticket in the vehicle and even took pictures of the vehicle with the ticket (unfortunately I have deleted them one week ago). Two months later after we returned the car, I received the fixed penalty charge from our car rental company claiming our failure to pay parking fee, the rental company had paid £60 to Armtracservices and deducted £80 from our credit card (plus £20 of admin fee). We challenged the ticket to Armtracservices immediately after we received the notice, we were told it's too late and the case was closed as the rental company had paid the penalty for us already. This is so RIDICULOUS , is this how they make money by issuing a ticket to every car, even if they have legally PAID accordingly? I am so disgusted by it, my beautiful impression of cornwall is totally ruined by them

    Talking about Armtrac - it looks like they got stitched up when their greed got the better of them. Sympathy from me - nil!  When you start working in a murky world like private parking it's inevitable really! I guess he gets a taste of how it feels to be ripped off! I think they got paid back £1 due to their partner burning/ laundering all that cash away. I have sympathy for that guys other victims though - but not Armtrac based on their behaviour! Karma I suppose!?!

    I would not use that rental company again.  Most have an option whereby they transfer liability and appeal to you.  It wasn't a fine nor a fixed penalty so it is unfair of a lease/hire firm to just pay it.

    I would leave an open review of your experience of the rental company on  social media plus their own platforms, Trustpilot and Google reviews to Warn other would be customers of this situation.
