Hi,
I sent off the statute barred document as per National Debtline only to get a letter from a debt collection agency based in Cleckheaton, Yorks.
I therefore can only deduce that the six year rule does not apply to these *******s. They say that my wife was over paid £350.000 back in 1992, yes 1992.
The leeches up in Yorkshire are demanding payment or else.
Does anyone know how the law actually stands when dealing with the DWP as the National Debtline seem to think that they are a law unto themselves.
Finally, my wife does not even know what these people are talking about and the DWP will not send any proof that this money is owed. This is therefore surely extortion ?

You owe the DWP money? Could you explain how this arose, please? If it's an overpayment of benefit entitlement then, no, it's not covered by the National Debtline advice. I think your debt counts as a "Crown Debt" and simply has to be repaid .. it's like owing tax, or VAT.
You must have missed this on the National Debtline Factsheet
"The Department of Work & Pensions (DWP) are still allowed to make deductions from your benefit for a debt over 6 years old as they don’t need to go to court to do this. This applies to overpayments of benefits such as Income Support, Job Seekers Allowance, Housing Benefit, Council Tax Benefit and paying back Social Fund Loans."
