Notice period during and after furlough

Options
Hi
Just wondering if anyone can help.
My notice will be handed in after I've been returned to work from furlough. This unfortunately is just how the timings of the new job have happened.
My notice period as in my contract is 4 weeks. I have been with the company less than 2 years.
I have a few questions that need some answers please

Do I need my return to full time work from furlough in writing?

If I am returned to work from furlough but then my notice is put in will I be paid at full pay for the notice period or furlough 80% amount?

If my notice is handed in while still on furlough will I be paid my notice at 80% furlough pay or my normal full pay amount?

I have also holiday days outstanding I understand these must be paid in my final pay at full pay unless agreed to take the holidays as notice?

While being on furlough I have only been paid 80% for bank Holidays. No top up to 100%. Now because of this should I be paid the remaining 20% for each bank holiday? My holiday allowance in my contract says 20 days plus bank Holidays. If I work a bank holiday I do get a day in leiu if that helps?

Sorry for all the questions I have read different posts but none seem to be the same as my situation

Thanks

Geoff

There is no specific requirement for your return to full time work to be in writing. What is more important is whether your contract of employment and furlough agreement reduce your pay to 80% whether you are on furlough or working, or whether the reduction applies only when you are furloughed. You need to review your contract of employment and furlough agreement to check.

If your pay has been reduced whether working or furloughed, your notice pay will be payable at 80% as it exceeds the statutory minimum period (1 week) by more than one week. If your pay is only reduced while furloughed, notice pay will be at full rate, unless you are furloughed again.

The 20 days minimum holiday should be paid at pre furlough rates, so 100%. Most employers apply the same rule to bank holidays, probably for the simple reason that most contracts won't specify which 20 days of your 28 day statutory entitlement are part of the 20 day minimum governed by EU law, which is what brings in the pre furlough rate. Your employer can make you take unused holiday in your notice period, whether you are furloughed or not (and it usually makes sense for them to furlough you), but they must give appropriate notice (twice the length of the holiday, although this can be amended by your contract of employment).
